ENTRY PERIOD: The Sweepstakes begins at 12:00 a.m. PST on February, 1st 2021 and officially ends at 11:59 p.m. PST on December 31, 2021 (“Entry Period”). All digital entries must be received by the end of the Entry Period.
ELIGIBILITY: This Sweepstakes is only open to (1) legal residents of the 50 United States and District of Columbia (2) who are at least 18 years old as of the date of entry, (3) who are current Foresight Policy Holders during the Entry Period who have accessed safesitehq.com on safesitehq.com or the Safesite Mobile App or who are individuals entering the Safesite Monthly Raffle! through the alternative methods of entry detailed in the Official Giveaway Rules (“Entrant(s)”). This Sweepstakes is void outside the 50 United States and the District of Columbia, and where prohibited. Proof of legal United States residency, age, and eligibility verification may be required.
Employees of Safesite: (“Sponsor”) and its affiliated companies (“Sponsor Affiliates”) or any of their promotional or advertising agencies with regard to this Sweepstakes and each of its and their respective parents, affiliates and subsidiaries, and each of their respective officers, employees, directors, members, legal representatives, agents, successors and assigns are not eligible, nor are members of these employees’ families (defined as parents, children, siblings, spouse, and life partners). Proof of legal United States residency, age, and eligibility verification may be required. THIS SWEEPSTAKES IS SPECIFICALLY VOID WHERE PROHIBITED BY LAW.
HOW TO ENTER: Individuals (“Entrants”) will receive (1) one raffle ticket for every (1) one safety action completed in Safesite effective 2/1/2021. Raffles will be drawn on a monthly basis, beginning with safety actions (observations, inspections, hazards, and meetings) starting February 1, 2021. Each winner will be announced by the 5th of the following month. Limit one prize per Foresight policy holder. Winners must be an employee of a company that has a Foresight worker’s compensation policy. In the event of dispute as to identity of Entrant, Sponsor’s business records will be relied upon to determine the identity of Entrant and to resolve such dispute. All entries submitted in compliance with these Official Rules and not disqualified are considered “Eligible Entries.”
IF YOU DO NOT WANT TO PARTICIPATE IN THIS SWEEPSTAKES, PLEASE SEND AN EMAIL WITH YOUR NAME, ADDRESS, AND POLICY NUMBER ASKING TO BE REMOVED TO INFO@SAFESITEHQ.COM AND YOU WILL NOT BE ENTERED IN ANY SUBSEQUENT SWEEPSTAKES OR RANDOM DRAWINGS.
Sponsor, Sponsor Affiliates, and each of its and their respective parents, affiliates and subsidiaries, and each of their respective officers, employees, directors, members, legal representatives, agents, successors and assigns (collectively, the “Released Parties”) are not responsible for lost, late, incomplete, garbled, illegible, or misdirected Sweepstakes entries, or for any error, human, technical or otherwise, which may occur in the processing of Sweepstakes entries. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. Any use of robotic, automatic, programmed or similar entry methods will void all such entries by such methods.
PRIZE DRAWING: The decisions of Sponsor, including the selection of Grand Prize Winner(s), are final and binding on all matters relating to this Sweepstakes. Odds of winning depend on the total number of Entries during the Entry Period. Grand Prize Winner selection will be conducted by random drawing from all eligible entries on the 5th following the entry month.
PRIZES: Each of the Raffle Prize Winners will receive one Ipad Pro (799). An Entrant can receive no more than one (1) Grand Prize.
Prizes are awarded “As Is”. Neither Sponsor nor Sponsor Affiliates make or offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Sweepstakes or any Prize or Grand Prize. Prize and Grand Prize details and availability are subject to change, in which case a prize of equal value may be substituted at Sponsor’s sole discretion. Prizes and Grand Prize consist only of the items listed, are non-transferable and non-exchangeable, with no cash redemption or substitution except that Sponsor retains the right to substitute a prize of equal or greater retail value (or at Sponsor’s election, the cash value of the applicable Prize). The Winner(s) is solely and fully responsible for any and all applicable federal, state, city, and local taxes (including income and withholding taxes) on the value of the Prize and, if applicable, will be issued an IRS 1099-MISC tax form for the retail value of the Prize. All costs and expenses associated with Prize or Grand Prize acceptance and use not specified herein as being provided, related to the Prize or Grand Prize, including but not limited to, any taxes and other expenses incurred by accepting the Prize or Grand Prize are the sole responsibility of the Winner(s). Vouchers and prizes cannot be shared with or given to insureds.
USE OF DATA: Sponsor may be collecting personal data about Entrants including, without limitation, complete name, zip code, email address, and daytime phone number (including area code) of the Entrants and/or Winners. Sponsor is entitled to use personal data contained in all entries in accordance with the Sponsor’s privacy policy. By participating in the Sweepstakes, Entrants hereby agree to all personal information uses and disclaimers as explained in Sponsor’s Privacy Policy located at safesitehq.com. Please click on the provided link to read and review our Terms + Conditions: https://safesitehq.com/legal/. Entrant may opt-out of receiving future communications as set forth in Sponsor’s Privacy Policy or as provided within any such marketing materials (e.g., using the “Unsubscribe” feature provided in the footer of Sponsor’s emails).
AGREEMENT TO OFFICIAL RULES: Participation in the Sweepstakes constitutes Entrant’s full and unconditional agreement to and acceptance of these Official Rules and Sponsor’s Privacy Policy at safesitehq.com/legal and to be contacted by telephone and/or email.
NOTIFICATION OF GRAND PRIZE WINNER(S): Grand Prize Winner(s) will be notified by available phone number and/or email address by Sponsor on or before the 5th of the following month following the eligible entry month. To claim a Prize, Sponsor may require Winner(s) to complete, sign, and return Affidavit of Eligibility/Liability Release/Publicity Release forms, and other applicable documents, if necessary, which may require a social security number, postmarked within five (5) days of the date on the notification. At Sponsor’s discretion, Winners may be required to produce photo ID or some other form of proper identification to claim any Prize. Sponsor reserves the right to substitute any Prize with prize of equal or greater value. If a potential Winner cannot be contacted, fails to timely claim the Prize, is disqualified, fails to timely execute and return any required forms, or if the Prize notification is returned as undeliverable, an alternate Winner will be selected from other potential winners and/or by random draw from all remaining eligible entries. If by reason or printing or other error, more Prizes are claimed than the number of Prizes set forth in these Official Rules, a random drawing will be held to award the advertised number of Prizes in the relevant category. Under no circumstances will more than the advertised number of Prizes be awarded.
Except where otherwise expressly noted in these Official Rules, the selection of all vendors, Prizes, products and services is subject to the Sponsor’s sole and absolute discretion. Additional restrictions may apply.
No refunds or credit for changes are allowed. No transfer of the Prize is permitted.
GENERAL CONDITIONS: The Sweepstakes is governed by the laws of the United States and the State of California, excluding conflicts of laws principles. All federal, state and local laws and regulations apply. SWEEPSTAKES VOID WHERE PROHIBITED BY LAW.
Except where prohibited by law, Winner(s) grants to Sponsor and its advertising agencies the right to use and publish Winner’s photo, image, name, likeness, voice, opinions, biographical information, video image and audio, and/or other indicia of persona and state of residence in any media to promote the Sweepstakes or similar sweepstakes or contests without additional compensation.
By entering, Entrants and Winner(s) release, indemnify and hold harmless Sponsor and the Released Parties from any and all liability for any injuries, loss or damage of any kind, including death, arising from or in connection with the Sweepstakes or receipt or use and/or misuse of any Prize. Under no circumstances will the Entrants or Winner(s) be permitted to obtain any award for, and the Entrants and Winner(s) hereby waive all rights to any claim(s), punitive, incidental or consequential damages, or any other damages whatsoever, including attorneys’ fees. Furthermore, Entrants and Winner(s) agree that any and all disputes and causes of action arising out of or connected with this Sweepstakes and the Prizes awarded shall be resolved solely by Sponsor, shall be final and binding, and without resort to any form of class action. Sponsor and Sponsor Affiliates shall not be responsible for Acts of God, government or government agency action or inaction, acts of terrorism, civil unrest or disturbances, riots, work stoppage delays, postponements, inclement weather, rescheduling or any other natural disasters outside its respective control.
Sponsor reserves the right to cancel or modify the Sweepstakes if fraud or any other factor impairs the integrity of the Sweepstakes or Sponsor’s ability to award Prize as determined by Sponsor in its sole discretion.
Entries are deemed made by the authorized policyholder at the time of entry. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized policyholder of the winning entry and is a legal United States resident and complies with all the eligibility requirements of these Official Rules. Prize will only be awarded to the authorized policyholder.
If, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if technical difficulties compromise the integrity of the Sweepstakes, Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers or otherwise interferes with the entry process or the integrity of the Sweepstakes), and to cancel, terminate, modify or suspend the Sweepstakes, in whole or in part, at any time without notice. In the event of such cancellation, Sponsor reserves the right to award Prize(s) in a random drawing from all eligible entries received before the time of cancellation.
Sponsor in no way promotes illegal acts, and any and all entries which include or promote illegal acts will be disqualified. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, including safesitehq.com, any combination thereof, or otherwise, including any injury or damage to Entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in the Sweepstakes.
Apple® , Yeti, Amazon.com Inc, LinkedIn.com, Facebook Inc, Twitter.com, Insurance Journal, and NUPC360 are not sponsors or involved in the activity in any manner.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR ALSO RESERVES THE RIGHT TO DISQUALIFY ANY ENTRANT.
Entrants in the Sweepstakes hereby consent to the exclusive jurisdiction and venue of California courts (state and federal) in San Francisco County for any causes or controversies arising out of the Sweepstakes. Winner(s) waives any and all objections to jurisdiction and venue in these courts.
